- These are the terms and conditions on which we offer items donated by footballers and their families for sale on our website footballers4change.com.
- Please read these terms carefully before you bid for or buy any item listed on our website. These terms tell you who we are, how you can bid for or buy items, how we will deliver purchased items to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
- Information About Us and How to Contact Us
- We are Footballers4Change Limited a company registered in England and Wales. Our company registration number is 11761275 and our registered office is at 2 Hilliards Court, Chester Business Park, Chester CH4 9PX.
- You can contact us by telephoning, texting or instant messaging via WhatsApp our customer service team at +44 7810 568328 or by emailing us at info@footballers4change.com or writing to us at 2 Hilliards Court, Chester Business Park, Chester CH4 9PX. We attend to requests during working hours which are 9am to 5pm Monday to Friday.
- If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us when you registered with us.
- When we use the words “writing” or “written” in these terms, this includes emails.
- Registration and qualification to use the Website
- If you wish to purchase or bid for an item listed on our Website you will be required to register with us by completing the registration form on our Website and submitting it to us. Only adults (that is, those aged 18 years and over) are entitled to enter into legally binding contracts and as a result only adults are entitled to register with us. Any individuals who are unable to form legally binding contracts are prohibited from buying or bidding for Items. By registering you are making a statement, upon which we are entitled to rely, that you are aged 18 years or older and capable of forming a legally binding contract.
- All information you provide shall be accurate and complete and all registration details shall contain your correct name, address, credit or debit card number and other requested details.
- Upon registration, in order to bid on an item, you will be required to purchase a “Become a Bidder” subscription fee of £0.30 to enable us to verify that you are a genuine bidder.
- On occasions certain individuals and members may be refused access to the Website. Such suspensions shall be within our sole discretion.
- We will only use your personal information as set out in our Privacy Policy at http://www.footballers4change.com/privacy-cookie/ .
- Items listed for sale on our Website
- We sell as agents for the person, family or organisation detailed on our Website (Donor) who have donated items to us in consideration of our agreement to donate the profits from the sale of such items to their nominated charity (also detailed on our Website).
- All items listed for sale on our Website are second-hand items, sold as is with all faults and imperfections and errors of description. We do not verify or warrant brand authenticity, or the quality or value of the items donated.
- We do warrant that items listed on our Website have been donated by the named Donor and mark all items with SelectaDNA Liquid (as this can wear off with multiple washes items are also sent out with a card marked with SelectaDNA Liquid) to enable us to confirm the veracity of the item should the item/card be returned to us for verification at a later date.
- We may without giving any reason refuse to accept the bidding of any person and in the case of a dispute as to any bid, we may immediately determine the dispute or relist the item.
- Items listed on our Website have been donated by in support of a charitable organisation nominated by the Donor and also detailed on our Website and we warrant that profits from the sale of such items will be donated to the relevant charity.
- While we will use all reasonable endeavours to make our Website available, we cannot guarantee that it will operate continuously or without interruptions. This could affect bidding or other aspects of an auction or sale.
- Price and Payment
- Items listed for sale on our Website are listed with:-
- a set purchase price in which case the item can be purchased by adding the item to your cart and paying the listed price; or
- a reserve price where the item is being sold by auction in which case the highest bidder when the auction ends shall have 24 hours to pay the amount bid after which time we may offer the item to the next highest bidder or re-list the item.
- What happens if we got the price wrong. It is always possible that, despite our best efforts, some of the items we sell may be incorrectly priced. We will normally check prices before accepting dispatching an item so that, where the item’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the item’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any items delivered to you.
- Minimum order value. Sustainability is one of our principle goals and in order to facilitate this we may set a minimum order level on our Website.
- When you must pay and how you must pay. All items must be paid for before we dispatch them. We accept payment with Stripe and Paypal.
- Items listed for sale on our Website are listed with:-
- Delivery
- The costs of delivery will be as displayed to you on our Website at the time of purchase and will depend on the items purchased and where items are to be delivered to.
- We will deliver items purchased by you to the address provided to us as soon as reasonably possible and in any event within 30 days after the day on which we receive payment and confirmation of delivery address. If delivery is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any items you have paid for but not received.
- If you fail to take delivery we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract and condition 9 will apply.
- Purchased items will be your responsibility from the time we deliver them to the address you gave us.
- Your Rights to End the Contract with us
- Under the Consumer Contracts Regulations 2013 you have a legal right to change your mind within 14 days of receiving an item and receive a refund subject to any deductions we may be entitled to make under condition 8.
- If you want to end the contract because
- we have told you about an error in the price or description of the item you have purchased (condition 2) and you do not wish to proceed; or
- there is a risk that supply of an item may be significantly delayed because of events outside our control; or
- you have a legal right to end the contract because of something we have done wrong
the contract will end immediately, and we will refund you in full for any items which have not been delivered to you.
- As items are second-hand and sold as is with all faults and imperfections and errors of description, they may only be returned outside the 14 day period referred to in condition 1 if they prove to have been both materially and incorrectly described when listed or condition 7.2 applies. If you have any questions or complaints about an item, please contact us using the methods set out in condition 2.2 above.
- How to End the Contract With Us (including If You Have Changed Your Mind)
- Tell us you want to end the contract. To end the contract with us, please let us know by contacting us as detailed in condition 2. Please provide your name, home address, details of the order and, where available, your phone number and email address.
- Returning items after ending the contract. If you end the contract for any reason after items have been dispatched to you or you have received them, you must return them to us. Please contact us using one of the methods detailed in condition 2 for a return label or to arrange collection. If you are exercising your right to change your mind under condition 7.1 you must return the item(s) to us within 14 days of telling us you wish to end the contract.
- Costs of return. We will pay the costs of return if conditions 2 or 7.3 apply. In all other circumstances (including where you are exercising your right to change your mind) you must pay the costs of return.
- How we will refund you. We will refund you the price you paid for the item including (if applicable) delivery costs, by the method you used for payment. However, if you are exercising your right to change your mind we may reduce your refund of the price (excluding delivery costs) to reflect any reduction in the value of the items returned, if this has been caused by your handling them in a way which would not be permitted in a shop. If we refund you the price paid before we are able to inspect the items and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.
- When your refund will be made. We will make any refunds due to you as soon as possible. If you are exercising your right to change your mind then if we have not offered to collect the item, your refund will be made within 14 days from the day on which we receive the item back from you. For information about how to return an item to us, see condition 2.
- Our Rights to End the Contract
We may end the contract for an item at any time by writing to you if you do not make any payment to us when it is due; or you do not, within a reasonable time, allow us to deliver purchased items to you. We will refund any money you have paid in advance for items we have not provided but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.
- Our Responsibility for Loss or Damage Suffered By You
- If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking our contract with you or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process. As we only supply the items for domestic and private use. If you use items for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
- We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; or for breach of your legal rights in relation to the items.
- Other Important Terms
- This contract is between you and us. No other person shall have any rights to enforce any of its terms.
- We may transfer our rights and obligations under these terms to another organisation. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.
- Each of the conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining conditions will remain in full force and effect.
- If we do not insist immediately that you do anything you are required to do under these conditions, or if we delay in taking steps against you in respect of your breaking the contract between us, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
- These terms are governed by English law and you can bring legal proceedings in respect of items in the English courts. If you live in Scotland you can bring legal proceedings in respect of items in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of items in either the Northern Irish or the English courts.
- Copies of the Auctions (Bidding Agreements) Acts 1927 and 1969 are available at our place of business.
